3 Aralık Dünya Engelliler Günü, Birleşmiş Milletler tarafından kabul edilmiş, engelli bireylerin hakları, onuru ve refahı konusunda farkındalığı artırmayı hedefleyen önemli bir gündür. Bu önemli tarih bir kutlama değil devletlerin ve toplumun engellilikle ilgili yükümlülüklerini ve sorumluluklarını hatırlatan bir eylem çağrısıdır. Bir hukuk kulübü olan Modern Hukukçular olarak farkındalığı yüksek bu özel günde engelli dostlarımızı ve kardeşlerimizi ziyaret ederek her daim yanlarında olduğumuzu bir kez daha hatırlattık. Onlarla ilgilenen kıymetli öğretmenleri ile değerli dostlarımızın toplum içerisindeki konumları ve sorunlarını ele aldık. Mevcut ve gelecekteki problemlerine hukuki perspektiften çözümler getirmek adına kendileri ile röportaj yaptık. Bize kapılarını açan ve ilgilerini eksik etmeyen Öncü Özel Eğitim ve Rehabilitasyon Merkezi’ne teşekkür ediyoruz.
Engellilik, sadece engelli bireylerin ve ailelerinin omuzlarında taşıdığı bir yük ya da yalnızca tıbbi yönleriyle ele alınacak bir durum değildir. Hukuki perspektiften de bu meseleyi ele almak oldukça mühimdir. Sosyal, Hukuk Devleti anlayışımızın temelinde, engelli vatandaşlarımızın ihtiyaçlarına kalıcı çözümler üretmek, onların hayatın her alanında etkin varlık göstermelerini desteklemek ve toplumla bütünleşmelerinin önündeki engelleri kaldırmak yer almaktadır.
Ülkemiz, Birleşmiş Milletler Engelli Haklarına İlişkin Sözleşme’yi (EHİS) 2009 yılında onaylayarak engellilerin insan hakları bağlamında korunması konusunda uluslararası yükümlülükler üstlenmiştir. Bununla birlikte 5378 sayılı Engelliler Hakkında Kanun, Anayasa’nın eşitlik ve sosyal devlet ilkeleri ile engellilerin hukuki statüsünü belirleyen normatif çerçeve belirtilmiştir.
Toplum içinde erişilebilirlik, eğitimde fırsat eşitsizliği, istihdamda ayrımcılık gibi problemler engelli bireylerin karşı karşıya kaldığı en büyük sorunlardandır. Bu sorunların çözümüne ilişkin yasal mevzuatların gerçek hayatta uygulama alanı bulamamasının eksikliğini hep birlikte hissetmekteyiz. Bu sorunların çözümünde hukuki düzenlemeler önemli bir ilerleme göstermiş olsa da uygulamada karşılaşılan yapısal sorunlar devam etmektedir. Erişilebilirlik, eğitim, istihdam ve adalete erişim gibi alanlarda yapılacak kapsamlı reformlar, engellilerin toplumsal hayata eşit katılımını sağlamanın temel anahtarıdır. Çünkü hepimiz bilmekteyiz ki engelli bireylerin güçlendirilmesi, yalnızca hukuki bir yükümlülük değil; aynı zamanda sosyal ve hukuk devletinin varlık şartıdır.
Özetle; özel gereksinimli çocukların hakları, sadece insani bir mesele değil, aynı zamanda uluslararası sözleşmeler ve Anayasa ile teminat altına alınmış hukuki bir zorunluluktur. Hukuk öğrencileri olarak, bu alandaki farkındalığın artırılması ve çözüm odaklı hukuki reformların talep edilmesi, sosyal hukukun ve hukuk devleti ilkesinin toplumsal refaha yansıması için hayati öneme sahiptir. Unutulmamalıdır ki;

December 3 is International Day of Persons with Disabilities, an important day recognized by the United Nations that aims to raise awareness about the rights, dignity, and well-being of persons with disabilities. This important date is not a celebration, but a call to action reminding states and societies of their obligations and responsibilities regarding disability. As Modern Lawyers, a law club, we visited our friends and brothers and sisters with disabilities on this special day of high awareness, reminding them once again that we are always by their side. We discussed the position and problems of our valuable friends within society with their dedicated teachers. We interviewed them to find solutions to their current and future problems from a legal perspective. We thank the Pioneer Special Education and Rehabilitation Center for opening their doors to us and showing us their interest.
Disability is not just a burden carried on the shoulders of disabled individuals and their families, nor is it a situation to be addressed solely from a medical perspective. It is also very important to address this issue from a legal perspective. At the core of our understanding of the Social State of Law lies the creation of permanent solutions to the needs of our citizens with disabilities, supporting their active participation in all areas of life, and removing the impedimen to their integration into society.Our country ratified the United Nations Convention on the Rights of Persons with Disabilities (CRPD) in 2009, thereby assuming international obligations regarding the protection of persons with disabilities in the context of human rights. Furthermore, Law No. 5378 on Persons with Disabilities sets out the normative framework that determines the legal status of persons with disabilities, in line with the principles of equality and the social state enshrined in the Constitution.
Problems such as accessibility in society, inequality of opportunity in education, and discrimination in employment are among the biggest problems faced by persons with disabilities. We all feel the lack of practical application of the legal regulations regarding the solution of these problems. Although legal regulations have shown significant progress in solving these problems, structural problems encountered in practice continue. Comprehensive reforms in areas such as accessibility, education, employment, and access to justice are the key to ensuring the equal participation of persons with disabilities in social life. Because we all know that empowering persons with disabilities is not only a legal obligation but also a prerequisite for the existence of a social and constitutional state.In summary, the rights of children with special needs are not only a humanitarian issue but also a legal obligation guaranteed by international treaties and the Constitution. As law students, raising awareness in this area and demanding solution-oriented legal reforms is vital for the reflection of social law and the principle of the rule of law on social welfare. It should not be forgotten that;
